Disney-Sony Movie Rights Deal Points to Future of Film Licensing

On the surface, Disney and Sony Pictures Entertainment seem to be two studios heading in opposite directions when it comes to business strategy.

Disney is investing huge sums of money and resources into building direct-to-consumer streaming platforms. Sony Pictures has vowed to stay on its traditional studio path, dealing high-end content to the highest bidders. But the two companies found common ground in a massive U.S. movie licensing deal that was more than a year in the making for Sony.

Netflix revealed that it will spend over $17 billion on content this year, according to its first-quarter earnings report.

“As we’ve noted previously, the production delays from Covid-19 in 2020 will lead to a 2021 slate that is more heavily second half weighted with a large number of returning franchises,” said the company in its letter to shareholders. “And while the roll out of vaccines is very uneven across the world, we are back up and producing safely in every major market, with the exception of Brazil and India. Assuming this continues, we’ll spend over $17 billion in cash on content this year and we’ll continue to deliver an amazing range of titles for our members with more originals this year than last.”

  • Written evidence submitted by the Music Managers Forum and Featured Artists Coalition

This submission focuses primarily on the inquiry’s third question, i.e. the economic impact and long-term implications of streaming on the music industry, in particular how the shift to streaming has exacerbated long-term issues within the music industry.

This submission will highlight issues around transparency regarding the deals done between the music industry and the streaming platforms and social media services. This means artists, songwriters and their managers are unable to audit the royalties those deals generate, and do not know how advance payments are shared out between stakeholders.

  • Rebalancing the Song Economy

After half a decade of streaming-driven growth the global music business hit a speed bump in the shape of the pandemic. Live music stopped in an instant, radio boomed then dipped and physical sales plummeted as stores closed. The music business will recover, but this enforced slowdown has had an important, unintended consequence: artists and songwriters have had to adjust to often dramatic falls in income – a light has been shone on music royalties.

  • Why It’s Misleading to Say ‘Apple Music Pays Twice as Much Per Stream as Spotify’

Early Friday, Apple Music sent a carefully worded letter to artists, music labels and publishers that briefly explained “how creators earn royalties” from the streaming service, which is the world’s second-largest, behind Spotify. The letter, which was not sent to the media, was obtained by the Wall Street Journal, which published a report that was not inaccurate but, since it was the only reliable source of the news for media outlets, was often inaccurately re-reported — most frequently in multiple headlines stating that Apple Music pays twice as much per stream as Spotify.

  • 15 Years of Spotify: How the Streaming Giant Has Changed and Reinvented the Music Industry

Ask any executive what the music business was like in the ’00s and their face may take on an expression more commonly associated with narrowly averted disasters like car accidents or, more accurately, attempted robberies. Due to peer-to-peer file-sharing platforms like Napster and Limewire, U.S. recorded-music revenues lost more than half their value in the early years of the 21st century, falling precipitously from an all-time high of $14.6 billion in 1999 to $6.7 billion in 2014 and 2015 (according to the RIAA) as songs transitioned from being sold on a physical object like a CD or vinyl to becoming a sound file that could be easily — and illegally — distributed for free. Piracy ran rampant as the music industry failed to come to grips with how quickly and drastically its world had changed. While iTunes brought some stability to a business model in freefall, in essence an entire generation grew up believing that it didn’t have to pay for music.
