(MLC Awareness Questionnaire 1/31/21 n=120.) The purpose of the questionnaire was to give the panelists some idea of the awareness level of attendees about the issues we intended to discussed based on early responses to the survey.     British songwriters Brian Clover and Scott McCulloch have asked the good old Ninth Circuit – everyone’s favourite circuit, surely – to revive their song-theft lawsuit against that notable – although only alleged – song thief The Weeknd.   • PRS’ Livestream License Faces Serious Backlash — “The Worst Possible Decision at the Worst Possible Time”

    Yesterday, PRS for Music unveiled an online portal through which livestream licenses can be purchased for small-scale remote gigs in the UK. Now, many organizations, artists, and venues are speaking out against the licenses’ rate structure.

    To recap, PRS for Music’s livestream licenses cost $30.87 (£22.50) for shows that earn up to $343.16 (£250) and $61.75 (£45) for gigs that bring in between £251 and $686.35 (£500). PRS indicates on its website that those who’re looking to purchase livestream licenses for sets with revenues in excess of £500 should “contact us for more info.”

  • Artists, managers and venues hit out at new PRS royalty rate for small-scale livestreamed shows

  • Article 17: (Mis)understanding the intent of the legislator

    Today, the French Government presents the second report on content recognition tools on digital sharing platforms commissioned by the Conseil Supérieur de la Propriété Littéraire et Artistique (High Council for literary and artistic property – CSPLA). The new CSPLA report, authored by Jean-Philippe Mochon (who had also authored the previous report on content recognition tools), focuses on “proposals for the implementation of Article 17 of the EU copyright directive” and marks an important and timely contribution to the discussion about the implementation of Article 17. It provides further insights into the positions taken by France throughout the discussion.

  • Now There’s a Licensing Platform for Small-Scale Livestreams In the UK

    PRS for Music announced its one-stop licensing portal today, via a formal release that was emailed to Digital Music News. The 107-year-old UK collecting society created the platform due to the “huge rise” in livestream concerts that’s arrived amid the pandemic, and the tool is available specifically for livestream events that generate $683.70 (£500) or less.

  • YouTube CEO says service has paid $30 billion to creators, artists, and media companies

    YouTube has paid creators, artists, and media organizations more than $30 billion in the last three years, CEO Susan Wojcicki announced in a Tuesday newsletter.

    In the letter, Wojcicki highlighted an Oxford Economics report saying the video hosting service contributed around $16 billion to the U.S. GDP in 2019, while supporting the equivalent of 345,000 jobs.

  • Spotify will force ad-free Premium users to listen to adverts

    Spotify users who have paid for the ad-free Premium subscription will still have to listen to adverts if they use the platform for podcasts.

    Users of the music streaming service are split into two tiers: Free and Premium.

    Free users can listen to music, interrupted with adverts, and have limits placed on playing and choosing music. Premium subscribers, by contrast, get “no ad interruptions”, according to the company’s website.

  • Divergence instead of guidance: the Article 17 implementation discussion in 2020

    It is less than five months until the implementation deadline for the 2019 Copyright in the digital single market directive (DSM Directive). So far, the pace of implementation has been relatively slow (no doubt at least in part due to the massive challenges that governments and the cultural sector are facing as a result of the pandemic).   • Estate for Bob Dylan collaborator sues for cut of $300 million Universal catalogue grab

    Bob Dylan has been sued by the estate of a former collaborator which argues that it is due a cut of the reported $300 million he received when he sold his songs catalogue to Universal Music Publishing late last year.   • Ahead of Joe Biden’s inauguration, Donald Trump faces expulsion from Screen Actors Guild

    NEW YORK (AP) — After leaving the White House, President Donald Trump may lose his SAG card, too.

    The Screen Actors Guild said Tuesday that the SAG-AFTRA board voted “overwhelmingly” that there is probable cause that Trump violated its guidelines for membership. The charges, the guild said, are for Trump’s role in the Capitol riot on January 6, “and in sustaining a reckless campaign of misinformation aimed at discrediting and ultimately threatening the safety of journalists, many of whom are SAG-AFTRA members.”

    Photographers and other creative individuals in the United States now have a more accessible means of pursuing copyright claims against those using images and works without permission. In a recent round of new laws passed as part of the Consolidated Appropriations Act 2021, a new Copyright Alternative in Small-Claims Enforcement Act (CASE) has been passed after a decade of campaigning by copyright pressure groups. The law introduces a Copyright Claims Board to deal with claims below $30,000 which will make pursuing cases much more cost-effective for individuals and small businesses.

  • The Oscar-Winning Film Shape of Water Must Defend Copyright Infringement Claims From Playwright

    Shape of Water, the winner of Best Picture, Best Director, and other Oscars, captivating audiences around the world, has come under fire for plagiarism. The 2017 film has been accused of borrowing heavily from a 1969 play called Let Me Hear You Whisper. The infringement claims were originally dismissed by the district court based on finding the two works shared merely a “basic premise” and “minor similarities.” Zindel v. Fox Searchlight Pictures, Inc., No. CV 18-1435 PA, 2018 U.S. Dist. LEXIS 123872 (C.D. Cal. July 23, 2018). On appeal, however, the Ninth Circuit reversed noting the district court judge was too quick to dismiss the case – reasonable minds could differ on whether the two works are substantially similar. Zindel v. Fox Searchlight Pictures, Inc., No. 18-56087, 2020 U.S. App. LEXIS 19444 (9th Cir. June 22, 2020).
